Abstract
Divorce is one of the most systems that embodies conflict of laws, which reflected negatively on the organization of divorce Moroccan immigrants, and on the stability of the European community, especially the European judiciary had ruled out the application of the Personal Status Code on divorce for being in breach of the defense and the principle of liberty and equality rights between men and women, which It violates the legal systems of these countries, which derives its authority from the international human rights conventions, and the evolution of the points of attachment in Europe to renounce citizenship officer contributed to exclude the application of national law on the dissolution of the marriage bond for the Moroccans in the countries of residence, but most of it raised problematic in terms of effects related to children or the person of the couple, and in front of this situation is the work of Moroccan legislature to pass a new family law within which many of the requirements to make it acceptable by the European courts.
