Abstract

تهدف هذه الدراسة إلى تقييم مدى كفاءة ضوابط دليل أحكام وإجراءات عقود الشراكة بين الجهات الحكومية والقطاع الخاص.

وذلك من خلال عرض بعض الضوابط التي أوردها الدليل الاتحادي وتلك التي أوردتها التشريعات المقارنة مثل جمهورية فرنسا وجمهورية مصر العربية باعتبارها أولى الدول التي أخذت بهذا النظام، والقانون المحلي لإمارة دبي ذلك أنه القانون المحلي الوحيد الناظم لعملية الشراكة بين الجهات الحكومية والقطاع الخاص لدى دولة الإمارات العربية المتحدة.

وقد تم تحليل الضوابط وفق الدليل المذكور آنفا، والمقارنة بين التشريعات أينما وجدت المفارقات، وذلك للتوجه نحو توصيات مناسبة.

وقد أظهرت نتائج الدراسة بأن المشرع الاتحادي قد سلك مسلكا مشابها لذلك الذي سلكه المشرع المصري، إلا أنه توجد بعض المفارقات مع المشرع الفرنسي على النحو الذي تم إظهاره في الدراسة.

The purpose of this study was to evaluate the efficiency of the federal guideline of the provisions and procedures of partnership contracts between the government and the private sector, in respect of some controls provided by the federal legislator to enter into a partnership.

This was done by presenting the controls sat out in the federal guideline in addition to the local law of Dubai, and those cited by comparative legislations such as French and Egyptian legislations as the first countries that adopted this system.

The criteria were analyzed in accordance with the above-mentioned guide and the comparison of legislations wherever the discrepancies were found, in order to move towards appropriate recommendations.

The results of the study showed that the federal legislator has taken a similar course as the Egyptian legislator, but there is some dissimilarity with the French legislator as shown in the study.
