Abstract

تحظى قضية تلوث الغذاء باهتمام واسع لما للغذاء من أهمية في الحفاظ على حياة الإنسان وصحته، حيث ذهبت العديد من التشريعات إلى الاعتناء بحماية سلامة الغذاء. وهدفت دراسة هذا الموضوع إلى بيان مدى كفاية التشريعات الصادرة في مجال حماية سلامة الغذاء سواء الاتحادية أو المحلية من خلال التحليل والمقارنة فيما بينها، فتوضح الدراسة ماهية سلامة الغذاء والمصطلحات المتشابهة والقريبة منها والمصادر المؤثرة عليها، إلى جانب أنها تستعرض التشريعات التي كفلت حماية الغذاء في الدولة.

كما سعت هذه الدراسة إلى إيضاح دور الجهات الإدارية المختصة في حماية سلامة الغذاء بما تملكه من وسائل وجراءات وتدابير وجزارات إدارية تستعين بها لتنفيذ وتطبيق تشريعات الغذاء للوصول إلى الغاية التي وجدت من أجلها وهي ضمان سلامة الغذاء وملاءمته للاستهلاك الآدمي.

وقد أظهرت نتائج هذا الموضوع أنه على الرغم من وجود التشريعات الخاصة بالغذاء وكفايتها إلا أنه يصعب تطبيقها في الواقع؛ لوجود تشريع اتحادي بشأن الغذاء وآخر محلي قد تتداخل وتتعارض الأحكام الواردة في كل منهما، إلى جانب عدم تقيد أصحاب المنشآت الغذائية بهذه التشريعات. كما أشارت النتائج إلى أهمية وجود التشريعات المساندة لقوانين سلامة الغذاء في حماية الغذاء في النواحي التي لم تتطرق لها تشريعات الغذاء أو غفلت عنها.

The issue of food pollution has a wide interest because of the importance of food in human life and health. Wherefore, many legislation tends to take care of Food Safety. The study of this subject aimed to indicate the adequacy of federal and local legislation that issued to protect Food Safety through analysis and comparison between these legislations. It clarifies the meaning of food safety and the terminologies similar to it and the sources, which are affecting it. Moreover, it reviews the legislation that ensured food protection in the country.

In addition, the study aimed to explain the importance of the role of administrative authorities to protect food through the powers, the procedures and the administrative sanctions to implement food legislation to achieve the purpose of what was found in a way that ensures food safety and suitability for human consumption.

The results of the topic have been shown that despite the existence of food legislation, but still difficult to apply it in the field due to the federal and the local legislation that may interfere or conflict with the provisions contained in each, as well non-compliance of the food legislation by food establishments’ owners. Furthermore, the results indicated the importance of legislations supporting food safety laws to protect food in areas that have not been addressed by food legislation.
