Abstract

خلال الفترة الماضية تعددت استخدامات الطائرات بدون طيار، وقطعت دولة الإمارات العربیة المتحدة أشواطا ھائلة في عملية تطوير الطائرات بدون طيار واستخدامھا لأغراض متعددة. ومزامنة مع الاستخدام المتعاظم لھذه التكنولوجيا الحديثة والتوسع في استخدامھا في العديد من المجالات لجلب النفع وتحقیق الرفاھیة للمجتمع، تظھر أھمیة بیان التنظيم القانوني الطائرات بدون طیار، وتسليط الضوء على المسؤولية عن أفعال ھذه الطائرات وما قد تسببھ من أضرار لأفراد المجتمع على نطاق واسع سواء في أجسادھم أو في ممتلكاتھم وحریاتھم، وذلك بھدف تحقیق التوازن بین الاھتمام بالسلامة البدنية والحاجة إلى تحفيز الابتكار وتطوير ھذه التقنیات الحدیثة.

تناولت ھذه الدراسة مفھوم الطائرات بدون طيار وأنواعھا، وقواعد تسجیلھا وتشغیلھا في دولة الإمارات، بالإضافة إلى خصوصیة المسؤولیة عن أضرارھا، كما تعرض الدراسة أحكام المسؤولیة المدنیة عن أضرار الطائرات بدون طيار بالبحث حول الأساس القانوني لھذه المسؤولیة ومدى ملائمة التشریع الحالي، وتطرقت الدراسة أيضا للبحث حول التأمين الإجباري المسؤولیة المدنیة عن أفعال الطائرات بدون طیار واتفاقيات الإعفاء التي ترد على ھذه المسؤولیة، بالإضافة إلى التعويض عن الأضرار المادية والمعنوية لأفعال الطائرات بدون طيار، إلا أنھ تبین عدم قدرة التشريع الحالي لاستيعاب جميع مستجدات المسؤولیة عن أفعال الطائرات بدون طیار كونھا تصنف من الآلات والأشياء الخطرة التي تتميز بصفات خاصة.

During the past period, drones have become more versatile. The UAE has made tremendous strides in drone’s development and used it for multiple purposes. With the growing uses of this modern technology in various areas, it is vital to explain the current drone’s legal regulation. As well as, highlighting the responsibility for its actions and the potential impact on the society on a large scale, whether it is in their bodies, possessions, or their freedom. In order to achieve the balance between the physical safety and stimulating innovation during the development of these modern technologies.

This study examines the concept of drones, their types, registration, and operation rules in the UAE, as well as the privacy of liability for their damages. The study also presents the provisions of civil liability for drone damages by researching the legal basis for this responsibility and the relevance of the current legislation. The study illustrates the compulsory insurance of the civil liability for drone actions and exemption agreements toward this responsibility. In addition, the compensation for physical and moral damages to drone actions were explained. It was found that the current legislation is insufficient to accommodate all the growing responsibilities for the actions of drones since they were classified as dangerous machines that have special characteristics.
