Abstract

تتناول هذه الرسالة المسؤولية المدنية عن إضرار المنتجات الطبية بالغير في القانون المقارن، وقد تضمنت بيان ماهية هذه المنتجات الطبية، ثم شروط تحقق هذه المسؤولية ما بين النطاقين الشخصي والموضوعي.

ثم تناولت بيان أحكام هذه المسؤولية من حيث آثارها وكيفية رفع دعاوى التعويض الخاصة بها، فضلاً عن كيفية دفع هذه المسؤولية وكيفية الإعفاء منها، وأخير اً تناولنا مسألة التأمين كحل يجب اتباعه لضمان حصول المضرور على التعويض

This thesis deals with civil liability with regard to pharmaceutical drugs and medical products under Comparative Law. It clarifies the nature of medical products and the conditions of liability whether at the personal or objective levels.

Furthermore, this thesis examines the rules and effects of liability, and how to file claims for compensation, as well as how to pay this responsibility and what are the main causes of exemption.

Finally, this thesis deals with insurance as a solution to ensure that the injured person is compensated.
