Abstract

The study deals with several points and questions relates to the execution of arbitral award such as the definition of an arbitral award, rectifying the different type of arbitral awards, the possibility to challenge an arbitral award, the conditions to execute an arbitral award.

The main question is about the arbitral award that can be compulsory executed and the necessity to rectify such an award to have an execution award.

The new subject in this thesis is the reading of the New York Convention and the understanding of the judiciary -specifically the UAE- towards the execution of an arbitral award, which another judgment has been made that challenge the validity of the award. Specially with the common wrong translation of the New York Convention.

تتطرق الدراسة إلى عدة نقاط وتسأ ؤ لات بمناسبة تنفيذ حكم المحكمين ومنيا تعريف حكم

التحكيم، وما هيه حكم التحكيم القابل للتنفيذ الجبري، والتصديق على أحكام التحكيم بأنواعها، وإمكانية

الطعن في حكم التحكيم، وشروط تنفيذ أحكام التحكيم، وتسأ ؤ لنا الرئيسي عن حكم التحكيم القابل

للتنفيذ الجبري وضرورة التصديق القضائي على هذا الحكم حتى يكون سندا تنفيذيا.

ومن أهم نواحي الجدة في هذا البح هو تقدير الموقف القضائي -خاصة في الإمارات-

تجاه التصديق على أحكام التحكيم الأجنبية التي صدر حكم أجنبي ببطلانها خاصة في ظل ترجمة

خاطئة ولكنها شائعة لاتفاقية نيويورك بشأن تنفيذ أحكام التحكيم الأجنبية.
