Abstract

تتناول هذه الدراسة موضوع الاستيقاف وأحكامه القانونية في قانون الإجراءات الجزائية لدولة الإمارات العربية المتحدة، وذلك لمعرفة ما إذا كان المشرع الإماراتي نجح في تحقيق الموازنة بين الحرية الفردية وبين حماية آمن المجتمع واستقراره، ويرجع موضوع الإشكالية لوجود تعارض بين المصالح الفردية ومصالح المجتمع، ولقد حاولت الدراسة الإجابة على هذه الإشكالية من خلال تقسيم البحث إلى مبحث تمهيد وفصلين، حيم يتضمن المبحث التمهيد ماهية الاستيقاف والتطرق إلى معرفة معناه من حيم اللغة والفقه والتشريع والقضاء، وكذلك يشتمل المبحث على بيان أهمية الاستيقاف، أما الفصل الأول فيشتمل على مبحثين وهما: تمييز الاستيقاف عن غيره، وتحديد طبيعته القانونية، وأما في الفصل الثاني فتطرقت فيه إلى الأحكام القانونية للاستيقاف، وذلك من خلال مبحثين وهما: سبب الاستيقاف، والآثار الإجرائية المترتبة على الاستيقاف.

ولقد خلصت الدراسة لدعوة المشرع الإماراتي للتدخل في تنظيم إجراء الاستيقاف كإجراء يوازن بين مصلحة وحريات الأفراد، وبين مصلحة المجتمع من آمن واستقرار.

This study examines the subject of awakening and its legal provisions in the code of criminal procedure of the United Arab Emirates, in order to determine whether the Emirati legislator has succeeded in balancing individual freedom. From protecting the security and stability of the community. The issue of the problem is due to conflict between individual interests and the interests of society. The study has tried to answer this problematic by splitting the search into a preliminary section and two chapters. Where it includes the primer what is the awakening is and what its meaning is in terms of language, jurisprudence, legislation, and the judiciary, and also includes a statement of the importance wake up, the first chapter includes two factors: discrimination against others, the determination of its legal nature, and in chapter 2, it addressed the legal provisions of the awakening, through two sections, namely: reason for waking up, and the procedural implications of waking up.

The study concluded with success of the Emirate legislature in balancing the freedoms of individuals with security and stability of the community.
