Abstract
The Impact of the Veto on the Effectiveness of the Security Council in Contemporary International Conflicts: "An Analytical Study"
The League of Nations, which was established in 1919 after World War I to maintain peace, failed in its mission. Therefore, in 1945 the victorious allies established the United Nations through San Francisco Conference on June 25, 1945. This was followed by the establishment of the Security Council, with its primary responsibility in maintaining international peace and security. The establishment of the Security Council represented a tremendous hope for achieving world peace after the horrors of World War II. However, The Cold War quickly impeded its work by two competing superpowers that obstruct the role of the Security Council through their excessive use of veto power. Many examples of that included Algeria War during the fifties in which the United Nations was unable to act due to the threat of the French veto. During the Vietnam War in the 1960s, the United Nations was powerless to intervene due to the threat of the American veto. The United States has used its veto frequently since the 1970s, especially regarding the Israeli question, in order to defend its ally Israel. Consequently, the UN failed to resolve the Israeli-Palestinian conflict.
This study will aim to examine the extent to which the veto is an obstacle in maintaining international peace and security, and to search for proposals to address this issue. This study will follow an analytical approach based in its theoretical aspect on previous studies and researches, with an applied aspect represented in examining the decisions of the International Peace and Security Council, especially those that the veto prevented it from maintaining international peace and security.
Arabic Abstract
فشلت عصبة الأمم - التي أنشئت في عام 1919 بعد الحرب العالمية الأولى للحفاظ على السلم - في مهمتها، وفي عام 1945 أنشأ الحلفاء المنتصرون الأمم المتحدة من خلال مؤتمر سان فرانسيسكو في 26 يونيو 1945م، وأسفر ذلك عن اضطلاع مجلس الأمن بمسؤوليته الأساسية وهي حفظ السلم والأمن الدوليين، ومثل قيام مجلس الأمن أملاً هائلاً في تحقيق السلم العالمي بعد أهوال الحرب العالمية الثانية، ولكن الحرب الباردة سرعان ما أصابت عمله بالشلل بسبب قيام القوتين العظمتين المتنافستين بعرقلة عمل مجلس الأمن باستخدام حق النقض (الفيتو) بشكل مفرط، كما تشهد لذلك أمثلة عديدة؛ ففي الخمسينات خلال حرب الجزائر لم تتمكن الأمم المتحدة من التحرك بسبب التهديد بالفيتو الفرنسي، وفي الستينيات خلال حرب فيتنام كانت الأمم المتحدة عاجزة عن التدخل بسبب التهديد باستخدام الفيتو الأمريكي، ومنذ السبعينيات استخدمت الولايات المتحدة الفيتو كثيرا، خاصة فيما يتعلق بالمسألة الإسرائيلية الفلسطيني. ستهدف هذه الدراسة لبحث مدى كون الفيتو عائقًا في حفظ السلم والأمن الدوليين، والبحث عن المقترحات الفعالة لعلاج هذا الموضوع، وستتبع هذه الدراسة منهجا تحليليا يعتمد في جانبه النظري على الدراسات والأبحاث السابقة، مع وجود جانب تطبيقي يتمثل في فحص قرارات مجلس الأمن، وبصفة خاصة تلك التي أعاقها الفيتو عن حفظ السلم والأمن الدوليين.
