Abstract

Judicial Oversight of the Decision to Terminate A Public Employee's Service Based on the UAE Judiciary

The examination dealt with judicial oversight of administrative decisions issued to terminate the staff member's service as a safeguard established by the staff member against the abuse of his or her right. The supervision examined the legality of the administrative decision issued to terminate the staff member's service formally and objectively, and the penalty for violation of the principle of lawfulness, namely, invalidity and judicial annulment. The research also dealt with the jurisprudence and the judiciary's views on the limits of the judge and is in the process of adjudicating the annulment proceedings and the differences in them. Some argued that the judge could not direct orders to the administration. Others argued that the judge could direct the administration and that the judiciary's position in the United Arab Emirates on that issue was different. The research also dealt with the legal implications of the judgements handed down in the termination action and enjoys absolute validity contrary to the general rule of relative validity of judicial decisions, The research also dealt with the mechanism for implementing the termination clause criminal liability of the executing officer ", and the liability that may result from its failure to carry out the sentence against it, as well as civil liability, which may be incurred by the administration as a result of its failure to implement the annulment judgement, must be compensated. The main findings of the research include the lack of legislation in the United Arab Emirates governing the implementation of administrative judgements in general, the annulment of decisions to terminate an employee's employment, and the disparity in the attitude of the UAE judiciary towards the judge's power to direct orders to the administrator upon the annulment judgement.

One of the most important recommendations of the research was to present the divergence of opinions of the UAE's Supreme Courts to the Unification of Federal and Local Judicial Principles, to enact legislation governing the implementation of administrative rulings in general, and to abolish in particular.

Arabic Abstract

تناول البحث الرقابة القضائية على القرارات الإدارية الصادرة بإنهاء خدمة الموظف باعتباره ضمانة من الضمانات المقررة للموظف من تعسف جهة الإدارة في استعمال حقها، وتقوم الرقابة القاضية بفحص مدى مشروعية القرار الإداري الصادر بإنهاء خدمة الموظف من ناحيتي الشكلية والموضوعية، وبين الجزاء المترتب على مخالفة قرار إنهاء الخدمة لمبدأ المشروعية وهو البطلان ويستوجب القضاء بإلغائه.

كما تناول البحث آراء الفقه والقضاء إزاء حدود للقاضي وهو بصدد الفصل في دعوى الإلغاء وبين أوجه الاختلاف فيها، حيث ذهب البعض إلى القول بعدم جواز القاضي توجيه الأوامر إلى جهة الإدارة، وذهب البعض الآخر إلى جواز قيام القاضي بتوجيه الإدارة، وبين أيضا اختلاف موقف القضاء في دولة الإمارات إزاء تلك المسألة.

وتناول البحث أيضا الآثار القانونية المترتبة على الأحكام الصادر ة في دعوى إلغاء قرارات إنهاء الخدمة، وبتمتعه

بحجية مطلقة على خلاف القاعدة العامة التي تقضي بالحجية النسبية للأحكام القضائية، كما تناول البحث آلية تنفيذه حكم إلغاء قرار إنهاء الخدمة، والمسؤولية التي قد تترتب على امتناعها عن تنفيذ الحكم الصادر في مواجهتها مسؤولية جنائية على الموظف المختص بالتنفيذ، فضلاً عن المسؤولية المدنية التي قد تترتب على جهة الإدارة نتيجة تقصيرها في تنفيذ حكم الإلغاء تستوجب معها التعويض.

ومن أبرز النتائج التي توصل إليها البحث خلو التشريعات في دولة الإمارات من نصوص تنظم مسألة تنفيذ الأحكام الإدارية عموما،ً والأحكام الصادرة بإلغاء قرارات إنهاء خدمة الموظف على وجه الخصوص، وتباين في موقف القضاء الإماراتي إزاء سلطة القاضي في توجيه الأوامر إلى جهة الإدارة عند حكم الإلغاء

ومن أهم التوصيات التي توصل إليها البحث عرض تباين آراء المحاكم العليا في دولة الإمارات على هيئة توحيد المبادئ القضائية الاتحادية والمحلية، وسن تشريع ينظم مسألة تنفيذ الأحكام الإدارية عموما،ً والأحكام الصادرة بالإلغاء على وجه الخصوص.
