Abstract

The spread of the Corona virus clearly affected the work of public utilities in the country, so it disrupted some of them and modified the way others work. The spread of the pandemic led to the innovation of new ways and means that were not familiar with the functioning of public utilities. One of the most important of these means is remote work, which is done through means Modern communication, including the Internet.
The study sought to achieve several objectives, including clarifying the principle of continuity of the public facility in normal and exceptional circumstances, and clarifying the rules and foundations of the public health system, especially under exceptional circumstances. The importance of the study lies in showing the impact of the Corona pandemic on the continuity of public facilities, and the study concluded with many results. The most important of which is: The discretion granted to the administrative authority allowed it to take all measures it deems appropriate to confront the pandemic, with the need to respect the principle of legitimacy and not to make administrative control a tool for violating the principle, and it is required in the administration’s work under exceptional circumstances that it assesses as much as necessary and does not exceed its limits, and it must be terminated in the event of necessity.

Arabic Abstract

أدى انتشار فيروس كورونا إلى التأثير بشكل واضح على عمل المرافق العامة في الدولة فعطل بعضها وعدل في طريقة عمل البعض الآخر فقد أدى انتشار الجائحة إلى ابتكار طرق ووسائل جديدة لم تكن مألوفة في سير المرافق العامة ومن أهم هذه الوسائل العمل عن بعد والذي يتم عن طريق وسائل الاتصال الحديثة ومنها الإنترنت.
وقد سعت الدراسة الى تحقيق عدة أهداف منها بيان مبدأ استمرار المرفق العام في الظروف العادية والاستثنائية، وبيان قواعد ومرتكزات النظام الصحي العام خاصة في ظل الظروف الاستثنائية. وتكمن أهمية الدراسة في بيان تأثير جائحة كورونا على استمرارية المرافق العامة، وقد خلصت الدراسة الى العديد من النتائج أهمها: إن السلطة التقديرية الممنوحة للسلطة الإدارية سمحت لها باتخاذ كافة الإجراءات التي تراها مناسبة لمواجهة الجائحة مع ضرورة احترام مبدأ الشرعية وعدم جعل الضبط الإداري أداة لانتهاك المبدأ، ويشترط في أعمال الإدارة في ظل الظروف الاستثنائية أن تقدر بقدر الضرورة وإلا تتجاوز حدودها ويتوجب إنهاء العمل بها في حالة انتهاء حالة الضرورة.
