Abstract
The Legal Future Of Telemedicine Technology
Over the past few years, the field of information and communication technologies (ICT) has experienced remarkable advancements that have brought about significant revolutions in various aspects of public life. One notable area that has been greatly influenced by these advancements is telemedicine. Telemedicine has had a profound impact on interpersonal relationships and the supply of medical services in both developed areas and remote. What sets telemedicine apart from traditional hospital healthcare is its ability to bridge the gap between doctors and patients without the need for physical proximity. However, the implementation of telemedicine in different countries requires the establishment of specific laws and regulations to address its unique nature. Unlike traditional healthcare, telemedicine presents complex legal challenges that need to be carefully discussed, resolved, and further evolved. The first chapter of this study delves deep into the nature of telemedicine technology, and it is divided into two sections. The initial section explores the conceptual and historical development of telemedicine, shedding light on its evolution over time. The latter section focuses on the stakeholders involved in telemedicine, emphasizing their significance and highlighting the limitations of this technology.
Moving on to the second chapter, titled "Legal Framework for Telemedicine Technology," consists of three parts. The first part takes an in-depth look at the requirements and obligations that come with practicing telemedicine. The second part delves into the nature of medical liability within the realm of telemedicine, addressing the legal implications that arise. Finally, the third part analyzes the legal system that governs telemedicine, with specific attention given to its applications and the various fields in which this technology is utilized.
Arabic Abstract
إن التطور المذهل الذي يشهده قطاع تقنية المعلومات والاتصالات قد أحدث ثورة كبيرة في شتى مجالات الحياة العامة وخاصة في مجال العلاقات الإنسانية والخدمات الطبية عن بعد، وقد كشفت التجارب العلمية عن إيجابيات هذه التقنية في تطور وإيصال الخدمات الطبية إلى المناطق النائية والمتطورة. وبالرغم من انتشار مجال التطبيب عن بعد في الكثير من بلدان العالم، والتي تختلف اختلافاً جذرياً مع تقديم الرعاية الصحية التقليدية التي تتم في المستشفيات دون الحاجة إلى وجود الطبيب والمريض في مكان واحد، ورغم تبني هذه التكنولوجيا في العديد من الدول، إلا أنها تحتاج إلى تشريعات خاصة تتميز بها عن الرعاية الصحية التقليدية، حيث إنها لا تتسم بالبساطة التي تتسم بها الرعاية الصحية التقليدية، حيث إنها تثير الكثير من الإشكاليات والتحديات القانونية التي نحتاج الوقوف عندها وإيجاد الحلول لها وتطويرها. تناولت في الفصل الأول ماهية تكنولوجيا التطبيب عن بعد حيث ينقسم الفصل إلى مبحثين، المبحث الأول بعنوان مفهوم التطبيب عن بعد والتطور التاريخي له، أما المبحث الثاني بعنوان أطراف التطبيب عن بعد وأهميته وتطرقت في هذا المبحث كذلك إلى بيان عيوب تكنولوجيا التطبيب عن بعد.
أما الفصل الثاني جاء بعنوان النظام القانوني لتكنولوجيا التطبيب عن بعد وينقسم إلى ثلاثة مباحث المبحث الأول يناقش شروط والتزامات أعمال التطبيب عن بعد، أما المبحث الثاني فتطرقت فيه إلى طبيعة المسؤولية الطبية للتطبيب عن بعد، وأخيراً المبحث الثالث يطرح ويحلل الأنظمة القانونية في مواجهة التطبيب عن بعد ويسلط الضوء على تطبيقات تكنولوجيا التطبيب ومجالاتها.
