Abstract

The research aims to take care of the human dimensions and elicit them from jurisprudential texts with their evidence and causes that were singled out by the Maliki jurists in their books according to a descriptive, inductive, analytical, and deductive approach, in order to show the greatness of Islamic legislation, its sophistication, and its consideration of people’s conditions and circumstances, which leads to their happiness and relieves them of embarrassment and hardship in line with the purposes of the Shariah. .

The study included a statement of the concept of the human dimension and its visibility in some of the issues and branches of jurisprudence dealt with by the Maliki fiqh and related to acts of worship, transactions, personal status, felonies, borders, etc., and the extent of the Shariah’s interest in it.

The study reached several results, represented in highlighting the attention of the Maliki jurisprudence to the human dimensions in their issues and their jurisprudential branches and their inferences, with a deep human view characterized by an understanding of the conditions of reality, by delving into the intentions of the texts without standing on their phenomena, as well as reflecting on calamities and jurisprudential developments.

The study recommends researchers and students of knowledge to expand research and study to highlight the human dimensions in the schools of jurisprudence that research studies have not yet addressed.
