Abstract

تتعلق الدراسة بموضوع العلاج بالخلايا الجذعية في القانون الإماراتي مقارنة بالفقه الإسلامي، ويعد هذا الموضوع من المواضيع الهامة في الوقت الراهن كونه يعنى بتقنية طبية ووسيلة علاجية حديثة اهتمت بها دولة الإمارات العربية المتحدة في القطاع الصحي الحكومي والخاص على حد سواء.

إلا أنه وبالرغم من ذلك نلاحظ غياب النصوص التشريعية الناظمة لهذا النوع من العلاج، وهو ما يستوجب تسليط الضوء على مشروعية وضوابط العلاج بالخلايا الجذعية في الدولة، وذلك من خلال البحث في القواعد العامة الواردة في القانون، وكذلك القواعد الطبية الخاصة التي تحكم العلاج بالخلايا الجذعية، لاسيما القانون الاتحادي رقم 7 لسنة 1975 في شأن مزاولة مهنة الطب البشري، والقانون الاتحادي رقم 4 لسنة 2016 في شأن المسؤولية الطبية.

ومن ثم نبين مدى كفاية وفاعلية هذه القواعد والتشريعات في تنظيم العلاج بالخلايا الجذعية في الدولة، ومدى الحاجة إلى سن نصوص تشريعية خاصة بهذا النوع من العلاج.

Stem Cell Therapy under UAE Law: A Comparative Study in Islamic Jurisprudence

Abstract:

The study is concerned with the subject of stem cell therapy in UAE law compared to Islamic jurisprudence, and this topic is an important subject at the present time because it means medical technology and a modern treatment method of interest in the United Arab Emirates in both the public and private health sector.

However, in spite of this, we note the absence of legislative texts governing this type of treatment, which should shed light on the legitimacy and controls of stem cell treatment in the country, through research in general rules contained in the law as well as special medical rules governing the treatment of stem cells, In particular Federal Law No. 7 of 1975 on the practice of the profession of medicine and Federal Law No. 4 of 2016 on medical responsibility.

Then, we show the adequacy and effectiveness of these rules and legislations in the regulation of stem cell therapy in the Emirates and the pressing need to enact legislative texts for this type of treatment.
