Abstract

The health care for inmates of penal institutions sentenced to penalties of deprivation of freedom has attained a considerable importance under the modern punitive policy, where it is easy for inmates without a disability to undergo rehabilitation programs. Therefore, the management of penal institution must provide treatment for physically and mentally ill inmates whether inside the institution.

Our study is limited only to physical illness. Providing inmate who got a serious physical illness during the period of execution of his sentence at the penal institution receives a significant attention in various penal systems. When the illness intensifies as to endanger the inmate’s life and the treatment can’t be provided or it takes a long time, with the need to have a special care that is not available at the penal institution, thus he is compassionately released under specific provisions and regulations. This study sheds lights on these regulatory provisions and regulations of the compassionate release system in some modern penal legislation.
