Abstract
The subject – matter of our research is the Criteria of nomination for the presidency of the Republic whether inFranceor inEgypt. It has been studied in two chapters where the first one has beenallocated for studying the application of nomination for the presidency of the Republic whether inFranceor inEgyptand the Second one has beenallocated for studying the competent authority for accepting the applications of nomination for presidency.
The second chapter isallocated for studying the Competent authority for accepting the applications of nomination whether inFranceor inEgypt. We find that the French legislator has given the ConstitutionalCouncil the mission of accepting and checking the applications of nomination in addition to publicizing the list of Candidates of presidency to realize transparency and to give the chance to the persons excluded from nomination to challenge the decision of the Constitutionalcouncil during a very short period of time.
Nevertheless in Egypt, a Commission has been established and called the Commission of the presidential elections. It undertakes to accept and check the applications of nomination for presidency in addition to publicizing the list of Candidates. But it is noticed that the decision issued by the Commission of the presidential elections is final and unchallengeable by any of the ordinary or extraordinary methods of challenge. The decisions of Commission may not be Construed or suspended
