The fate of penalty
Abstract French:
Le sort de la peine se manifeste par un de trois suivantes: la suspension de la peine; l'exécution de la peine; ou sa extinction.
D'abord, la suspension de la peine se réalise ou bien par le sursis simple, ou le sursis avec mise à l'épreuve, ou le sursis assorti de l'obligation d'accomplir un travail d'intérêt général. Cette étude a éclairé ses conditions, ses effets, soit qu'il est concomitant à la condamnation, soit qu'il est postérieur à la condamnation.
Ensuite, quant à l'exécution de la peine, il faut parles d' établissements pénitentiaires, son régime, qu'il soit en milieu fermé, ou en milieu ouvert, en plus du juge de l'application des peines.
Enfin, quant à l'extinction de la peine, il est nécessaire de parler de la prescription de la peine, la grâce présidentielle et judiciaire, l'amnistie, ses conditions et ses effets de l'amnistie, et la réhabilitation judiciaire et légale, ses conditions et ses effets.
The fate of penalty
Abstract English
The fate of the sentence is manifested by one of the following three: the suspension of the sentence; the execution of the sentence; or its extinction.
First, the suspension of the sentence is carried out either by the simple suspension, or the suspension with probation, or the suspension accompanied by the obligation to perform community service. This study has shed light on its conditions, its effects, either that it is concomitant with the conviction, or that it is subsequent to the conviction.
Then, as for the execution of the sentence, it is necessary to speak about penitentiary establishments, its mode, that it is in closed environment, or in open environment, in addition to the judge of the application of sentences.
Finally, as for the extinction of the sentence, it is necessary to speak about the prescription of the sentence, the presidential and judicial pardon, the amnesty, its conditions and its effects of the amnesty, and the judicial and legal rehabilitation, its conditions and effects.
