Abstract

إن الأحكام بصفة عامة، والأحكام الجنائية بصفة خاصة ذات أهمية وخطورة بالغتين، والأحكام الجنائية إضافة إلى ما ترتبه من آثار عقابية جنائية فإنها تكون ذات أثر ونتيجة إدارية في بعض الأحيان، ولذلك كان لا بد من أن يأصل القضاء الإداري في أحكامه ومبادئه النطاق الذي لا يجب أن تتعداه الأحكام الجنائية أمامه، ولذلك كان للقضاء الإداري منذ عهد قديم - نسبي ا - كلمته في أثر الحكم الجنائي أمامه، ولأجل ذلك وقف الباحث في تحديد ماهية حجية الحكم القضائي، أهميتها، وشروط إعمالها، وكيف أنه يمكن الخروج أحيانا عما هو معروف حول وحدة الخصوم والسبب والمحل في الدعويين السابقة واللاحقة، كما وسنرى الفرق بين الحكم البات والحكم النهائي.

وأثر الحكم الجنائي يختلف باختلاف نوعية القضاء الإداري) قضاء إلغاء-قضاء تعويض (، وذلك من خلال أجزاء الحكم الجنائي التي تحوز الحجية أمامه، وأيض ا من خلال الحديث عن مدى ونطاق مضمون الحجية، والحالات التي يجوز له فيها طرح الحكم الجنائي من أمامه رغم كونه حكما جنائيا باتا مستوفٍ لجميع اشتراطات صحته، وأنه ليس في كلال أحوال الحكم بالبراءة معناه عدم المجازاة إداريا، وأيضا فلا يعني الحكم بالإدانة دائما استتباع المجازاة إداريا، كما أنه ولما كانت الأحكام الجنائية تتعلق في معظمها بج ا رئم تمس بشرف أو أمانة الموظف فلا بد لنا من تعريف تلك الج ا رئم وحدودها وكيف تعامل القضاء في إسباغها اعلى الواقعات المعروضة عليه.

ويتضح أثر الحكم الجنائي أيضا أمام قاضي قضاء التعويض، وذلك من خلال مدى مساهمة الحكم الجنائي أو البت في مسألة تحديد المسؤولية التقصيرية، أي إثبات ركن الخطأ، ومن ناحية أخرى مدى تأثير الحكم الجنائي في مسألة تقدير التعويض، وطالما كان الحديث عن التعويض فلا بد من ذكر مسألة تقادم دعوى التعويض المرتبطة بالدعوى الجنائية والقضاء المختص بها والوقت الذي ينبغي فيه تقدير التعويض.

Judgments in general and criminal judgments in particular, are of significant importance and seriousness. In addition to the consequences of penal punishment stipulated by the criminal judgments, such judgments sometimes have administrative effect and result. Hence, the administrative judiciary must identify, in its principles and judgments, the range, which criminal judgments shall not exceed. Therefore, the administrative judiciary has always had, relatively for long, its own stand regarding the effect of the criminal judgment before it. Thus, the researcher addressed the nature, importance, and conditions of using of the force of the judicial judgement, and how to break the deadlock of what is already known about litigants unity, and the cause and subject matter of the precedent and subsequent lawsuits, and the difference between the definitive judgement and final judgement.

The effect of the criminal judgment varies according to the type of the administrative judiciary (e.g. annulment judiciary, compensation judiciary), through the elements of criminal justice which possess the force before it. Also, the extent and range of the substance of the force, and the situations, which allow the judge to set the criminal judgment aside despite being a definitive criminal judgment having all its authenticity requirements. However, an acquittal judgment does not always mean the impossibility of administrative penalty nor does a conviction judgment always mean a subsequent administrative judgment. Furthermore, since criminal judgments mostly deal with and offenses which breach employee’s honesty and trust, we have to define those offenses and their limits, and how judiciary deals with cases brought before it.

The effect of the criminal judgment is also obvious before the compensation judiciary through the extent of the contribution of the criminal justice or deciding on the question of identifying the tort liability (i.e. proving of tort element) beside the effect extent of the criminal judgment on the question of compensation assessing.

As far as compensation is concerned, it is necessary to mention the question of limitation of the compensation lawsuit associated with the criminal lawsuit and the competent judiciary and the time in which compensation shall be assessed.
