Abstract

تتناول الدراسة طبيعة المواجهة الجنائية لتمويل الإرهاب في التشريع الجنائي لدولة الإمارات العربية المتحدة، حيث قام الباحث بتبيان السياسة التشريعية التي تبناها المشرع في تجريمه لتمويل الإرهاب وفقا للقانون الاتحادي رقم 7 لسنة 2014 في شأن مكافحة الجرائم الإرهابية وكذلك المرسوم بقانون إتحادي رقم 20 لسنة 2018 في شأن مواجهة جرائم غسل الأموال ومكافحة تمويل الإرهاب وتمويل التظميات غير المشروعة.

واقتضت طبيعة الدراسة تقسيمها إلى ثلاثة فصول رئيسية، بحيث يتناول الفصل الأول منها ماهية تمويل الإرهاب وذلك ببيان مفهوم تمويل الإرهاب في اللغة والفقه والتشريع والقضاء، وتمييزها عما يختلط بها من جرائم أخرى، ويتناول الفصل الثاني من الدراسة أركان جريمة تمويل الإرهاب وبيان الركن المادي والمعنوي فيها، ويتناول الفصل الثالث والأخير الأحكام الجزائية والإجرائية التي قررها المشرع الإماراتي لجريمة تمويل الإرهاب، كما أختتمت الدراسة بخاتمة أجملت النتائج والتوصيات، ولذا قد خلصت الدراسة إلى الآتي:

أولا: اقتراح إعادة صياغة المادتين 29 و 30 من القانون رقم 7 لسنة 2014 في شأن مكافحة الجرائم الإرهابية لجعلها أكثر وضوحا ولتجنب المفردات والعبارات المكررة، واختصارها فيما يلي: يعاقب بالسجن المؤبد أو المؤقت الذي لا تقل مدته عن عشر سنوات كل من:

  1. قددم أمدوالاً أو جمعهدا أو أعددها أو حصدلها أو سدهل للغيدر الحصدول عليهدا أو اكتسدبها أو أخدددذها أو أدارهدددا أو اسدددتثمرها أو حازهدددا أو نقلهدددا أو حولهدددا أو أودعهدددا أو حفظهدددا أو استخدمها أو تصرف فيها أو قام بأية عملية مصرفية أو مالية أو تجارية، وكان ذلك بقصد استخدامها مع علمه بأنها سوف تستخدم كلها أو بعضها في ارتكاب جريمدة إرهابيدة أو - - كانت متحصلة منها أو كانت معددة لتمويدل تنظديم أو شدخإ إرهدابي أو مملوكدة لده وكدان على علم بحقيقة أو أهداف أو غرض هذا التنظيم أو الشخإ الإرهابي.
  2. حول أو نقل أو أودع و اسدتبدل أو اكتسدب أو حداز أو اسدتخدم أو أدار أو حفدظ أو اسدتثمر أو بدل أو أخفى أمدوالاً بقصدد تمويده مصددرها غيدر المشدروع أو أخفدى مكانهدا أو طريقدة التصرف فيها أو حركتها أو ملكيتها أو الحقوق المتعلقة بها، وكان عالما بأن الأموال كلهدا أو بعضها متحصلة من جريمة إرهابية أو مملوكة لتنظيم إرهابي أو كاندت غيدر مشدروعة ومملوكة لشخإ إرهابي أو معدة لتمويل تنظيم أو شخإ إرهابي أو جريمة إرهابية.

ثانيا: نقترح إضافة تجريم التحريض والاتفاق والمساعدة على تمويل الإرهاب كصورة من صور المساهمة الجنائية الأصلية.

ثالثا: اقتراح إدراج مواد تجرم التعامل بالعملات الرقمية المشبوهة حيث ثبت استخدامها كوسيلة من وسائل تمويل الإرهاب، ونقترح على السلطات إصدار عملات رقمية وطنية وإصدار التشريعات والقوانين المنظمة لها وذلك لتوفير مظلة قانونية لتنظيم تداولها والرقابة عليها.

رابعا: اقتراح إضافة مواد تتضمن تحديداً للظروف المشددة في جريمة تمويل الإرهاب، والتي من شأنها أن تشدد العقوبة إلى الإعدام في حال قيام الشخإ بتمويل جريمة إرهابية تستهدف سلامة رئيس الدولة أو أحد أعضاء المجلس الأعلى للاتحاد أو المرافق العسكرية أو النووية أو دور العبادة، أو في حال استخدام الأموال في عمل إرهابي أدى إلى إزهاق أرواح مجموعة من الناس.

The study addresses the nature of criminal countering of financing of terrorism in the criminal legislation of the United Arab Emirates. The researcher have clarified the legislative policy adopted by the legislator in criminalizing the financing of terrorism in accordance with Law No. 7 of 2014 concerning combating terrorism crimes and Law No. 20 of 2018 concerning countering money laundering crimes and combatting financing of terrorism and financing of unlawful organizations .

The nature of the study has required to be divided into three main chapters, the first chapter addresses the definition of financing terrorism through clarifying the concept of financing terrorism in language, jurisprudence, law and legislation, and distinguishing it from other crimes. The second chapter of this study addresses the elements of the crime of financing terrorism and clarifying the material and moral element therein. The third chapter deals with the penal and procedural provisions determined by the UAE legislator for the crime of financing terrorism. The study has concluded with a conclusion that has summarized the conclusions and recommendations. Therefore, the study has concluded as follows:

First: A proposal has been made for the reformulation of articles 29 and 30 of Law No. 7 of 2014 concerning combatting terrorism crimes to make them clearer and to avoid repeated words and phrases. They are summarized as follows: The following shall be punished by life imprisonment or temporary imprisonment for a period of not less than ten years:

  1. The one who provides, collects, prepares, obtains, facilitates obtaining, acquires, receives, manages, invests, possesses, sends, transfers, deposits, saves, uses or disposes of any funds, or performs any banking, financial or commercial operation, in order to use these funds – and he knows that all or some of these funds are going to be used in committing a terrorist crime, all or some of these funds are obtained from committing a terrorist crime, or that all or some of these funds are intended to finance a terrorist organization or a terrorist, or owned by a terrorist organization or a terrorist, and he has been aware of the fact, purpose or objective of the terrorist organization or the terrorist
  2. The one who sends, transfers, deposits, changes, acquires, possesses, uses, manages, saves, invests, exchanges or conceals any funds to disguise their illegal source, or conceals their place, method of disposition, movement, ownership or rights, and he knows that all or some of these funds are obtained from committing a terrorist crime, or that all or some of these funds are intended to finance a terrorist organization or a terrorist, or owned by a terrorist organization or a terrorist.

Secondly: A proposal has been made for adding articles on criminalization of incitement, agreement and assistance in financing of terrorism as a form of the original criminal contribution.

Thirdly: A proposal has been made for stipulating articles that criminalize dealing in suspicious digital currencies as it has been proved that such currencies are used as a means of financing terrorism. We propose that the authorities should issue national digital currencies and issue legislations and laws to provide them with a legal umbrella to regulate their circulation and control.

Fourth, A proposal has been made for adding articles on specifying the aggravating circumstances in the crime of financing terrorism, which, in their turn, would increase the penalty to death if a person finances a terrorist crime targeting the safety of the head of state or a member of the Supreme Council of the Union, military or nuclear facilities or places of worship; or in the event of using the funds, which are the subject-matter of the crime, are used - actually - in killing a group of people .
