Abstract
خلا ل الفترة الوجيزة الماضية، تعددت استخدامات الفضاء الخارجي، وكان الاستخدام
التجاري للفضاء الخارجي أحد أهم هذه الاستخدامات، حيث ظهرت العديد من الأنشطة التجارية
في الفضاء. كما أصبح القطاع الخاص أحد أبرز الناشطين في ميدان الفضاء، مما جعل الدول
تضع قوانين خاصة لتنظم شروط ترخيص أنشطة القطاع الخاص، وتنظم أحكام المسؤولية عن
الأضرار التي تحدثها. كما أن الأنشطة التجارية في الفضاء الخارجي تواجه العديد من
الإشكاليات المتعلقة بالحماية القانونية لها، ومقبلة على مزيد من التحديات والتطورات
المستقبلية.
وفي هذا البحث نحاول تسليط الضوء على موضوع الاستخدام التجاري للفضاء
الخارجي من خلال التعرض للأنشطة التجارية التي يتم ممارستها حاليا في الفضاء الخارجي،
كما يعرض البحث لأهم الإشكاليات المعاصرة وأهم التحديات المستقبلية التي تقف عائقا أمام
تطوير الأنشطة التجارية في الفضاء الخا رجي. وقد خلصت الد راسة إلى الأنشطة الفضائية وإن
كانت منظمة في بعض جوانبها بموجب قانون الفضاء الدولي، إلا أنها أظهرت عدم كفاية هذا
القانون لاستيعاب جميع مستجدات وتطو ا رت الأنشطة الفضائية.

In recent years, outer space usages have multiplied, and commercial Utilization has been one of the most significant. Thus, several commercial activities have emerged in space. The private sector has also become one of the most prominent active parties in the field of space exploitation, which has led States to enact special laws governing licensee requirements for private-sector activities. Therefore, regulating Provisions of liability for any possible damage. Furthermore, commercial activities in space face many legal protection obstacles and would meet further challenges in the future.
This paper intends to shed light on the commercial Utilization of outer space by examining current commercial activities undertaken in outer space. It discusses the most important contemporary problems and also discusses the most important challenges that could face the development of commercial Utilization of outer space. This study concluded that even though some aspects of space activities are regulated under international space law, its provisions, however, are still insufficient to accommodate all developments of outer space activities.
