Abstract

تثیر السفن ذاتیة القیادة العدید من الإشكالیات القانونیة، سواء من حیث المركز القانوني للسفینة، أو من حیث المسؤولیة المترتبة على أعمالھا، وذلك في ظل ما تتمتع بھ ھذه السفن من خصائص فريدة، لعل أبرزھا الاستقلالية والذكاء والقدرة على اتخاذ القرار.

وعلیھ سلط ھذا الباحث الضوء على السفن ذاتية القيادة من خلال بیان النظام القانوني للسفن ذاتية القيادة، والبحث في التحديات التي تعرضھا ھذه السفن والمعنى القانوني لھا وحقوقھا، ومدى إمكانية منح ھذه السفن الشخصیة القانونیة. كما يسلط البحث الضوء على المسؤولية عن أفعال السفن ذاتیة القیادة، الأساس القانوني لھذه المسؤولیة، وموقف المشرع الإماراتي منھا.

وتوصلت الباحثة إلى أن السفن ذاتیة القیادة وإن كانت تخضع لنفس المفھوم القانوني والاتفاقيات الدولية الخاصة بالملاحة البحرية إلا أنھا تحمل بعض الخصوصیة نظرا لطبیعتھا، وھو ما يستدعي تفسیر وتطویع النصوص القانونیة لتوافق التطور التكنولوجي لھذه السفن، ريثما یتم تنظیم جمیع الجوانب القانونية الخاصة بھا من خلال اتفاقيات دولية خاصة.

Comments

The emergence of unmanned ships gave rise to many problems. Whether in terms of the legal status of the ship, or in terms of the responsibility arising from its actions. This thesis thus explores those problems in light of the unique characteristics of those ships, perhaps the most prominent of them being independence, intelligence, and decision-making ability.

Furthermore, this thesis sheds the light on the unmanned ships by explaining their legal system, the challenges faced, their rights, and the extent to which those ships can be granted legal personality. This research also highlights the view of the Emirati legislator on the responsibility of the unmanned ships actions and the legal basis for such responsibility.

The researcher concluded that although unmanned ships are subject to the same legal concepts and international agreements of the maritime navigation, they carry some peculiarity due to their nature. This requires the interpretation and adaptation of new legal concepts that are compatible with the technological development of those ships until all the legal aspects are settled through international agreements.
