Abstract

مما لا شك فيه أن المعاهدات الدولية أصبحت تنظم الحياة القانونية داخل الدولة وذلك بسبب دخولها في كثير من المجالات التي كانت في وقت سابق حكرا على قواعد القانون الداخلي.

وبسبب هذه الأهمية يأتي هذا البحث ليتناول فكرة الأثر القانوني للمعاهدات الدولية في النظام والقضاء الوطني وما قد يصادف تلك المعاهدات من مشاكل عملية وهي في طريقها لإنتاج آثارها القانونية وعلى وجه الخصوص تنازعها مع قواعد القانون الداخلي وتطبيق القضاء الوطني لها.

ويهدف هذا البحث إلى معالجة ما يعانيه النظام القانوني في الكويت والإمارات من عدم وجود حلول دستورية في حالة تنازع تلك المعاهدات مع القوانين الداخلية وكذلك نأمل من خلال هذا البحث إلى تصحيح نظرة القضاء الوطني للمعاهدات الدولية والخلط بين نافذها وبين الاحتجاج بها، آملين في ذلك كله أن يكون للمعاهدة الدولية فاعلية وتأثير حقيقي داخل أروقة القضاء الوطني علاو ة على سموها في نظام الدولة الدستوري على غيرها من القوانين.

ولدراسة الموضوع تفصيلا فقد تم تقسيمه إلى ثلاثة فصول، نتناول من خلال الفصل الأول علاقة القانون الدولي بالقانون الداخلي وموقف كلا من النظام القانوني الإماراتي والكويتي من هذه المسألة. ثم يأتي الفصل الثاني متناولا مسألة نفاذ المعاهدة الدولية في النظام القانوني الوطني والعمل بما جاء بها من أحكام وذلك للتفرقة بين نفاذ المعاهدة الدولية وبين العمل بها أمام القضاء الوطني وما قد يرتبه هذا العمل من تنازع بينها وبين القوانين الداخلية.

وبعد ذلك يأتي الفصل الثالث والذي يعد انعكاسا عمليا لما يتعامل عليه القضاء الكويتي والإماراتي بالنسبة لتلك المسائل المرتبطة بالمعاهدة الدولية، وباختصار شديد يأتي هذه البحث ليتتبع المعاهدة الدولية منذ لحظة دخولها إلى النظام القانوني الداخلي إلى أن تنتج آثارها القانونية

Comments

There is no doubt that international treaties have a role in regulating legal and judicial systems within states. This is due to the fact that they have become concerned with many fields that used to be exclusively subject to domestic law. Based on the above stated fact, this research will address the idea of the effects the treaties may have on the legal and judicial systems within states, as well as the practical problems encountered by those treaties while producing their legal effects and, in particular, their conflict with the rules of domestic law and their application by the national judiciary.

The aim of this research is to address the legal system in Kuwait and the United Arab Emirates as there is no constitutional solution in the case of conflict between treaties and domestic law. We also hope through this research to correct the view of the national judicial systems towards international treaties and the confusion between their entry into force and between invoking its provisions, hoping that the international treaty will have a real effect and influence within the national judicial system and the adoption of the idea of the supremacy of treaties over domestic laws in the constitutional systems.

This research will be divided into three chapters; Chapter One deals with defining the relationship between international law and domestic law, and the position of both the United Arab Emirates and Kuwaiti legal systems towards this issue. Chapter Two deals with the question of the entry into force and the application of its provisions within national systems, in order to distinguish between the entry into force of an international treaty and its functioning before the national judiciary, and what that might imply of conflicts between them and the domestic laws. The third Chapter is a reflection of the real practices of the Kuwaiti and Emirati judiciaries with regards to an international treaty. In summary, this research studies the international treaty from the moment it enters into the domestic legal system until it produces its legal effects.
