Abstract

يتناول هذا البحث تسليط الضوء على موضوع (أحكام المسؤولية الجنائية للشخص الاعتباري في التشريع الإمات راتي) لأهميته ونظراً لاتساع نشاطات هذه الشخصية الاعتبارية بسبب التطورات التي أفرزها العصر الحديث، وتملّكها لإمكانات ضخمة من أجل ممارسة أنشطتها، وامكان حصول أخطاء فيها مقابل المنافع التي تحققها، فقد تستخدم هذه النشاطات كغطاء لإخفاء بعض الجرائم.
وتجدر الإشارة إلى أن دراسة المسؤولية الجنائية للشخص الاعتباري يحتم علينا التطرق إلى نطاق هذه المسؤولية، وكذلك إلى دراسة الشرط الذي تتطلبه المادة (65) من قانون العقوبات الإماراتي لقيام مسؤولية الشخص الاعتباري جنائيا، والمتعلق بوقوع الجريمة بواسطة شخص طبيعي له صفة أو علاقة معينة بالشخص الاعتباري، وهو كونه ممثلاً أو مديراً أو وكيلا لذلك الشخص، والى بحث ومناقشة الاجتهادات القضائية في هذا الخصوص لبيان مدى موافقتها لنص المادة (65) سالفة الذكر.

ولبيان المسؤولية الجنائية للشخص الاعتباري، وبيان أحكام تلك المسؤولية على شكل صحيح، فقد تناول البحث بيان نطاق وشروط المسؤولية الجنائية للشخص الاعتباري، من حيث توضيح النطاق الخاص بتلك المسؤولية وبيان شروطها، الجزاءات الجنائية محل التوقيع على الشخص الاعتباري.

كما استعرض البحث كذلك عدة أحكام قضائية صادرة من المحكمة الاتحادية العليا ومحكمة تمييز دبي للتوصل هل هناك تعارض في تلك الأحكام التي أوضحت المسؤولية الجنائية للشخص الاعتباري وهل تقع أم لا وبيان عقوبتها.

وخلصت الدراسة الى أن كلا من المحكمة الاتحادية العليا ومحكمة نقض أبوظبي تتجه إلى إدانة الشخص الاعتباري من غير أن تتم معرفة الشخص الطبيعي مرتكب الجريمة، ومن ثم تحديد علاقته بالشخص الاعتباري، مما يعد تجاوزاً عن الشرط الذي حدده المشرع في المادة (65) من قانون العقوبات الإماراتي لمساءلة الشخص الاعتباري، والمتمثل في وجوب أن ترتكب الجريمة من شخص طبيعي ذي صفة معينة حددتها المادة المذكورة، وذلك بأن يكون ممثلا أو مديراً أو وكيلا للشخص الاعتباري.

This research focuses on the subject of the provisions of the criminal liability of a legal person in the UAE legislation because of its importance. Due to the expansion of the activities of this legal personality due to the developments of the modern era, and the huge potential for its activities and the possibility of errors in return for the benefits it achieves, these activities are a cover to hide some crimes. It should be noted that the study of the criminal liability of a juridical person requires us to address the scope of this responsibility, as well as to study the condition required by Article 65 of the UAE Penal Code for the criminal liability of the legal person, relating to the crime by a natural person having a specific status or relationship with the legal person , As a representative, director or agent of that person, and to discuss and discuss the jurisprudence in this regard to indicate the extent of its consent to the text of Article (65) above.

In order to clarify the criminal responsibility of the legal person and to properly describe the provisions of that liability, the study dealt with the scope and conditions of criminal liability of the legal person, in terms of the scope and conditions of that liability, the criminal sanctions to be signed by the legal person. The study also reviewed several judicial decisions issued by the Federal Supreme Court and the Dubai Court of Cassation to determine whether there is a conflict in those provisions that clarified the criminal liability of the legal person and whether or not it is located and the statement of its punishment The study concluded that both the Federal Supreme Court and the Abu Dhabi Court of Cassation tend to convict the legal person without knowing the natural person who committed the crime and thus determine his relationship with the legal person, which is considered a violation of the condition specified by the legislator in Article 65 of the Penal Code To be held accountable by the legal person, that the offense must be committed by a natural person of a particular character identified by the said article by being a representative, director or agent of the legal person.
